Copyright and Fair Use?

Hey all, Question, my client and friend Stephen Bishop, http://stephenbishop.net has a great deal of work in the entertainment industry. I know when I edited his demo reel and uploaded to youtube, immediately warner and others allowed the video but wiped out the audio. so I uploaded to vimeo. What I'm asking is I build his app so he can connect to his fans, have agents and his publicist have it on their mobile device rather then streaming from the web. Am I able to incorporate logos like sag-aftra and movie posters he's been in like how imdb has on his online profile. Any experience from Apple rejecting Apps that obviously incorporates images and video that we don't own? Thanks for any suggestions. Ed

I don't think they would have an issue with that..just look at all of the logo and movie quizzes that were all over the app store earlier this year. Apple seems to let that stuff pass through pretty easily. If worse comes to worse, couldn't Stephen just contact the various studios he's worked for and get their direct permission?

I think if i'm just referencing the art work its ok, worried about having my clients demo reel incorporated into the build so agents dont use their bandwidth on their mobile device, when pitching their client or casting. Gone are the days of burning Demo Reels onto DVD. No actor that I know of will contact the studios for permission, I would think since his movie posters were out in the public its fair use. It's hard enough to go to the producer and editor to get an HD version of their scene, I have to actually wait till it does go on sale or from my dvr.

Making sure the app is cached is going to be important for showing to people. I once had a nightmare of a time when showing to someone my app, and while the maps data was loading, the mobile data ran out! Luckily, the guy I was presenting to was sort of my friend, and he accepted the offer. That shows how important demos are. I could only really recommend one thing. Although you can enable caching on most screens, I'm never confident with this. I have reverted to making a local app especially for my phone, or clients' phones. They way you can do this is rather simple. You don't need to re-create a new app or anything. The only way to guarantee that your app will work offline is to have all the files stored locally, not online. This can mean that you end up with a massive sized app though. However, we plan to only use this demo version for selected phones, so if you have the space on your phone, it doesn't really matter. I would use the JSON Snippet Keeper to duplicate the JSON, and then modify small things in the JSON code. Although it sounds challenging, it would be much easier than making a new app with local file names. Please do contact me if you need any help with this. I'll be happy to help.

Thanks Thomas, what I was thinking is using Adobe premiere to create a custom mp4 file that would be small enough to have his demo reel stored locally, my target application either iphone or ipad, most likely ipad is what agents take with them open a browser such for their clients imdb bookmark then play their video. there's a huge niche market that I can tap into if the prototype im making right now works, a 3 min 15mb mp4 clip wont put a dent on the idevices storage of gb. So it will be useful. To answer the game salad is it worth building gaming apps. The key is to have a distribution network in place, so there are eager and willing people to download your freemium with IAP installed. Here's what I'm doing: Step 1: find something trending and create something useful that others will want it. Thus creating your buyers market. can be jesus screenlock images or a simple desktop wallpaper ie. Avengers came out in summer 2012. I created a windows rainmeter wallpaper theme unique enough that no one else has my setup. STEP 3: Find an SDK that the learning curve is ok, from my research and my friends in the gaming industry, Game Salad is their choice. STEP 4: Contact those who have Favorited my rainmeter wallpaper theme I think I have 350 in my deviantart account and ask them to beta test out your game, give them unlock codes for free lifetime. (I call my marketing generals) STEP 5: Launch the freemium model, and say for a free code visit 1 of my 350 beta testers (really you are reciprocating by sending traffic their way) and them being worldwide is key to getting your app, your game trending instantly. My mac was acting up during the webinar and I wanted to pass on my knowledge to the group when we were trying to kill time. Hope this contribution helps! ~Cheers ED
