Copyright

I want to design and create a quiz app about a popular BBC tv show just multiple choice nothing extravagant. They will be my own questions. My question is will this be copyright infringement the name of the show is in the title and a couple of sound effects from the show for right and wrong answers.

Possibly copyright and/or Trademark. But I'm not an expert...

Sound effects, yes most likely a violation of someone's copyright. (Sounds probably don't belong to the show.) Now if your quiz was designed to poke fun and or critique the show the it would probably be ok under US Law. Name of show in title? (Trademark issue) Depends how you do it. My Guide is called: MySkylla's Guide to Buzztouch That's ok because I clearly stated that I, MySkylla, have a guide to Buzztouch. There's no confusion about the guide's orgin. But if I called it, ''Buzztouch's How-To Guide'', it implies that it's by Buzztouch and would be a Trademark violation, because the title would lead you to believe it's part of Buzztouch. Fred

The sound effects might be problematic, since you didn't create them. I'd stay away from those (though there are apps in iTunes that use Star Wars sound effects, and I seriously doubt they licensed them. Perhaps if they're short enough, it's not an issue). I have a hard time believing that creating a quiz with questions about the show would be a trademark infringement. How does that differ from you and I getting together and asking each other questions about the show? As long as your quiz questions are original (meaning you came up with them), it doesn't seem to be an issue to me. But that's just my opinion! Mark

Sound effects if their short enough? Not according to many successful court cases. Creating a quiz is not a Trademark violation. The improper use of the Trademark in the title could be. Fred

Worst that could happen is that Apple sends it back to you with a copyright issue, and you retool the app to remove it. Best case is that it passes, which I would take as a sign that it's probably OK. Let Apple do all the legal work! Mark

No, actually the worst is that you'll get a retroactive bill from one of the music companies asking for lots of money. If you ever had a business that uses music such as a restaurant, bar, office, etc. you'll know that's a really big issue. And no, just because Apple approves it you're not in the clear. Fred

it's a tv show there are hundreds of quizzes on the internet thought it would be nice to have an app for one of my favourite shows. Have found some similar quizzes that have been in the store for a while produced by the same broadcasters so I'll give it a whirl
