You have to become a registered iOS developer, which requires a $99 yearly payment, then go through some legalese with contracts and such through iTunes Connect.

Alright thats what i thought. if i download xcode can i still start programming or do i have to pay the fee to start

xcode is free - you just have to pay to be able to start putting the app on actual devices. You can test your app in the iPhone simulator before you have to do that, though.

xcode does not work on Windows, you need a Mac.

or use the Windoze software, Eclipse.
